A GAME OF [DEADLY] CHICKEN The game, you see, is that the FDA pushes its deadly agenda through Codex (where it is the dominant dog and gets whatever it wants). Then, because the standard has been accepted by Codex, the FDA brings brings home these really bad regulatory strategies and introduces them here. So the FDA is using Codex to force worse and worse food standards on the US (and global) food supplies. That way, the FDA's intent to "HARMonize" with Codex is easily fulfilled, piece by piece. In his speech introducing this bill, Dr. Paul said, " "The FDA continues to frustrate consumers' efforts to learn how they can improve their health....FDA bureaucrats are so determined to frustrate consumers' access to truthful information that they are even evading their duty to comply with four Federal court decisions vindicating consumers' First Amendment rights to discover the health benefits of foods and dietary supplements.... FDA bureaucrats have even refused to abide by the DSHEA section allowing the public to have access to scientific articles and publications regarding the role of nutrients in protecting against diseases by claiming that every article concerning this topic is evidence of intent to sell a drug.... Because of the FDA's censorship of truthful health claims, millions of Americans may suffer with diseases and other health care problems they may have avoided by using dietary supplements. Exercise real Congressional oversight over the FDA. The FDA is out of control and the American people are its victims. Separate food and drug regulation since the FDA cannot do both jobs. Congress needs to divest the FDA of its food regulatory responsibilities and let the FDA continue to regulate drugs and drugs only. Congress made a deadly mistake when it created a single agency to regulate both food and drugs in 1938. The impact of clean, unadulterated food on health is to help keep people healthy. That lowers drug use which, in turn, lowers drug profits. Stubblebine III has returned to the Nation's Capital to impress upon Members of Congress the importance of protecting the safety of America's food supply. Briefing Congressional staff, Gen. Stubblebine warns that giving the FDA dual responsibility for both food and drug regulation puts the nation's food supply at serious risk. Pressures on the FDA to degrade the food supply for commercial reasons linked to "Users Fees" for drug regulation lead to the diseases of under nutrition: cancers, heart disease and stroke, diabetes and obesity. These conditions are the principle killers in the developed world and represent the lion's share of pharmaceutical profit. The FDA Does NOT Want to Hear From You. Too Bad! OK. Let's fact the facts: The FDA does not really want to hear what you have to say about anything. Your snail mail letters, for example, are not even tallied. According to the Supervisor of the Office of the Receiver of Dockets, they are just stored in the FDA reading room where people can look at them if they want. Your direct email comments are now blocked. They do, however, want to hear the beautiful sound of huge high ticket "User Funds" hitting the till, the wonderful rustle of a letter saying that a grant proposal has been approved by a drug company, of the welcoming committee showing a former FDA official, now a new drug company executive around his offices which are, of course, much larger than the one he occupied at the FDA last week, of applause at a drug company sponsored "educational seminar" which the very well compensated FDA expert gives for the drug company whose product he is reviewing in the guise of a neutral scientist for FDA approval. They listen really hard for those sounds. We know that. Consider the FDA's CAM Guidance which could criminalize just about everything Americans do to stay out of the clutches of the illness industry. First they literally hid the fact that they had put out a Guidance on CAM from December 26, 2006 to February 26, 2007. Then they made the public comment period absurdly short for such a massively important topic (only until April 30, 2007). Your comments forced them to extend it, of course. Next they made sure that their submission link for those comments was not working. No link, no comments. No public input. The Natural Solutions Foundation called the supervisor of the Receiver of Dockets and got another link meaning that the only reliable way to submit comments was through that link. In fact, 588,000+ people tried to use it. Because of various (but predictable) attacks, "ONLY" 197,000+ comments hit the FDA's computer! Not even Washington can ignore that kind of outpouring! But the bureaucrats who are trying to take away your freedom (and your health, remember) for the benefit of the multinationals are playing a thrust-parry-counter thrust kind of game. The FDA, no longer funded primarily by public funding, but by Big Pharma's "User Fees" (turning it into a client agency of the drug companies) is on the attack again. How can the public trust this agency to oversee food safety? This time, when they issued their unprecedented third regulatory move hostile to natural health in less than a year they changed the rules: you can no longer submit your comments by email unless you use the FDA link which is, quite predictably, "broken" much of the time. The FDA is trying to block your comments on the very important Guidance on Health Claims. They found a way to prevent your emails and set a ridiculously short time for Public Comment during the summer vacation, no less. So, We'll FAX Our Comments to the FDA! And we'll fax ( http://salsa.democracyinaction.org/o/568/campaign.jsp?campaign_KEY=12189 or http://tinyurl.com/24mrn8 ) them by the many hundreds of thousands. And, just to make things better, when you fax through our link, even if the FDA fax runs out paper or they turn them off, the Natural Solutions Foundation has the legal record of the transmission so we can count them or print them out and deliver them if necessary. They can run, but they cannot hide from "Vox Populi", the Voice of the People, YOUR voice! Reality Check Faxes cost money. We have never charged for emails because, although each one costs us money to submit, we know that people are used to free emails and did not want to limit a single person from sending out those vitally important communications. No one pays our way and no one covers our expenses (often including registration at these events). We hold meetings with Congressional staff and elected representatives. Another Attack In our last email, Reading the Fine Print to Get It Right! - August 21, 2007, we discussed two pieces of distortion which we felt needed correction since they were pretty important and were circulating around the internet confusing several issues. In order to preserve the dignity and decency with which the Natural Solutions Foundation always conducts itself and its affairs, we pointedly did not name names, nor did we make this a personal attack. We corrected facts which we believe to be wrong in the spirit of truth, not the unseemly attacks which are so often a part of the sickest and least productive parts of the Health Freedom movement. Predictably, a rebuttal was forth coming. Sadly, the rebuttal was another in the series of personal attacks on me and attacks on our organization and its integrity. What none of us needs is another war of words and ill feeling.There are plenty of those around, some of them directed at the Natural Solutions Foundation. You may have noticed that we never respond to them. We do urge people who are so inclined, however, to write to the propagators of these attacks and ask to see the data upon which they rest. Since there is none, that is an interesting exercise: the replies would be funny if they were not so wasteful of time and resources. So, suffice it to say that the Natural Solutions Foundation stands firmly behind our interpretation of the facts as presented in our most recent blast and that those facts were not only checked by me, but by our excellent legal council as well to assure compete accuracy. We do not mind debate, but we adamantly deny that vicious personal attacks have any place in winning and keeping our health freedoms. As I said in that blast, you CAN count on the Natural Solutions Foundation for accurate, relevant, timely and helpful information. As Gilbert and Sullivan noted in their satirical operetta "Things are seldom what they seem, Skim milk masquerades as cream."  It takes a good deal of work to figure out what´s skim milk and what´s cream in the health and health freedom areas and sometimes conflicting information can be confusing. The purpose of this email is to provide much needed information on two important areas currently filled with a good deal of needless confusion. The first is a piece of seemingly good news that is really bad while the second is a piece of seemingly bad news that is really good.  Skim milk and cream, indeed!  Nano Victory A recent internet announcement trumpeted what is at best a minor victory in Europe, in which supplements, which are under a major assault by the restrictive and destructive European Food Supplements Directive (EFSD) garnered a legal victory such that natural source of supplements are no longer in danger, now that they are considered as foods. We agree with the basic principal: supplements are foods and therefore considered safe. First, the background.  You probably already know that the European Union (EU) is on a path to eliminate all high dose nutritional supplements.  They passed the EFSD which gives the central government the authority to remove supplements which do not conform to their restrictive limitations on which supplements may be sold (very few) and which dosages are permitted (very low). This Directive was challenged in the European Court system.  In fact, the European Court of Justice (ECJ) received arguments including scientific dossiers on the issues in this case in January, 2005.  The Natural Solutions Foundation as an organization and I as a physician and scientist were proud to be signatories on a scientific dossier supporting the use of high dose nutrients for health maintenance and promotion.  This document also made the point that natural source nutrients were biologically and biochemically superior to, and different from, synthetic source nutrients.  Natural source nutrients are safe, beneficial and extremely important to the health of people eating modern industrialized foods and living in a toxic world.  Synthetic ingredients are not the same as natural ones, although our FDA has taken the unscientific position that they are the same. As an aside, the Natural Solutions Foundation feels so strongly about this that we provide an online store, www.Organics4U.org , where you can access totally organic, all natural nutrients for yourself and those you care about. You may also recall that on July 4, 2005, to the exuberant jubilation of the US Codex Manager, Ed Scarbrough, PhD., the restrictive and dangerous Vitamin and Mineral Guideline was ratified by the Codex Alimentarius Commission.  This documents literally mandates deadly under nutrition in the international trade of nutrients since, for example, permitted maximum doses of nutrients may be only 15% higher than the amount of that nutrient found in unprocessed food.  A 1000 mg Vitamin C tablet would be illegal in international trade.  So would a 500 mg one.  So would a 250 mg one. A few days later, the ECJ gave its ruling on the legal challenge to the EFSD and ruled that it would remain intact meaning that only those permitted nutrients would survive, so effective nutritional therapy would be eliminated in the EU.  It did rule that natural source supplements might still be used, but that the doses were still far too small to satisfy the biological diversity of each person´s individual needs. At the time, one of the organizations involved in the suit touted that as a great victory and, while congratulating the President of the organization, I questioned the meaning of a ¨victory¨ in which micro doses of natural sources were still in, but meaningful doses of either natural or synthetic nutrients were out.  His answer was "We´ll figure that out later." Now It´s Later and the Europeans are faced with a real challenge to Health Freedom So when an associated organization recently sent out an email trumpeting the ¨Victory¨ that allows natural source nutrients to be treated as foods, not drugs, we share their delight.  After all, we helped bring about this ruling.  The highly significant US 1994 Dietary Supplement Health and Education  Act (DSHEA) pioneered the critically important idea that nutrients are foods and, like foods, generally regarded as safe so we can have as much of them as we like, just as we can have as much lettuce or lamb or lasagna as we like.  This idea is under significant attack in this country as you will see when you read the second part of this email. What we don´t share is their interpretation of the meaning of this confirmation. It´s kind of like when Moses came back from Mt. Zion with the tablets and all the Israelites crowded around him, eager to know what had happened. Moses said, ¨Well, I´ve got some good news and some bad news for you¨.  The good news is that I got Him down to 10.  The bad news is that Adultery is still in.¨ The Bad News The good news, of course, is that natural source ingredients are in.  The bad news is that nutrients, foods or not, are still limited to micro doses.  Those micro doses are intended to make sure that people eating a Codex compliant, corrupted and toxic food supply will become sick and that they will have no recourse or resource other than dangerous, expensive, ineffective pharmaceuticals.  To see more about how that works, watch my Codex lecture at www.HealthFreedomUSA.org or at www.GlobalHealthFreedom.org. Now for Some Good News that Looks Bad Everybody is entitled to make a mistake.  Congress makes them all the time.  Consider: on May 9, 2007 the Senate overwhelmingly passed the misnamed, wrongheaded, dangerous and irrational FDA Revitalization Bill, S. 1082.  By throwing power and money at an out of control, deadly and corrupt organization, the bill supposedly would curb and correct these problems.  Members of the US Senate attached some amendments to protect dietary supplements from this huge mistake of a law.  In fact, Senators Harkin, Hatch and Durbin inserted language which specifically exempts products covered by DSHEA, that is, dietary supplements, from this law. (608 - Rule of construction: nothing in this title "shall be construed to affect..." regulation under DSHEA or AER [Adverse Event Reporting] law). The same law was railroaded through the House last month with no amendments permitted so that this vitally important protection for supplements against the determined attack of the FDA is lacking. Natural Solutions Foundation Takes Action You may recall that we headed for Washington to help assure that your right to chose to take dietary supplements would not fax to the ax of this really bad bill.  Ralph Fucetola visited important Congressional Offices to assure that the compromise version of the bill which would be reported out of Conference Committee would contain the protective 608 language. The good news? We were assured that it would and that there was no danger to supplements and were thanked profusely for our diligence in focusing our large and vocal base on this issue.  Astonishingly, yet another health freedom organization got this one wrong, big time.  They mis-read the law and took us to task for the way we read it by saying that the FDA Revitalization Act has nothing to do with Dietary Supplements, that the amendment section 6 (which includes Section 608 quoted above) deals only with pet food and our concerns about this law are unfounded.  Now we know that a lot of people give their pets dietary supplements, but Section 608 is specific and the assertion that our concern is unjustified is not only a mistake, but a pretty big blooper that has confused quite a number of people.  Here´s the Straight Story To quote Ralph´s recent blog on the subject at http://vitaminlawyerhealthfreedom.blogspot.com/, ¨´While there are a number of bad clauses in what we call the FDA "enabling act" because it rewards a failing agency with more power to abuse, the House version of the bill does not mention foods or dietary supplements. The Senate version has an additional section 6 (sponsored by Senator Durbin) which was originally inspired by recent bad food (including pet food) imports. That section is about food safety and establishes an "adulterated food registry." Even after assurances from Senator Kennedy, on the Senate record, that the law would not be used against food supplements, Senator Harkin and the others demanded that language protecting dietary supplements be added to the law. They were supported in this by thousands of constituent messages to Congress through the Natural Solutions Foundation web site.¨ The Natural Solutions Foundation knows that the proposed statutory language was so vague that it actually allowed FDA more room to attack supplements, not less. Thus, while not supporting the bill, we do applaud section 608 since it protects supplements from what bill supporters claim would be an unlikely attack on supplements but which we see as a continuing attempt by the drug industry and their captive legislators and regulators to knock out the opposition to drug use: health, especially in the form of dietary supplements. If the food safety section 6 remains in the final law, we are assured by our friends "on the Hill" the DSHEA product exemption will remain in place. Ralph makes a really interesting point. ¨Those who criticize us apparently trust the FDA rather more than we do. We, on the other hand, agree with Dr. Ron Paul, who earlier this year called an FDA move against alternatives "an abuse of FDA power..." Giving the FDA more power, more money from Big Pharma´s ¨User Fees¨ and more incestuous conflicts of interest will allow it to continue its stated policy of 'harmonizing' our health freedoms to international restrictions.  That means only one thing: Codex.  The EU EFSD is the result of harmonization with Codex.  Is that what we want? We reject that approach and will continue to be a strong voice for freedom of choice in healthcare. That is consistent with the purpose of the Natural Solutions Foundation's: to protect and promote health freedom in the US and around the world. One of the ways we do that is to educate Congress and decision makers about Natural Solutions that will enable people to control their own healthcare decisions. August 14, 2007 Amazing Victory for Health Freedom in America By Rick Shalvo Health Freedom Advocate One of the greatest physicians of our time, board-certified oncologist and anti-aging specialist James Forsythe, M.D., H.M.D., has finally been cleared of any wrongdoing and elevated to the level of protocol opinion leader after a long series of vicious attacks initiated by a rogue FDA agent. These attacks were then perpetuated by the U.S. Attorney's office in the form of a criminal indictment and an unrelenting investigation. Please give generously!       Health Freedom Protection Act From a previous article by Rick Shalvo May 17, 2006   H.R. 4282, the Health Freedom Protection Act, introduced by Congressman Ron Paul, MD (R-Texas) et al., is clearly the most important piece of health-related legislation in Congress at this time. The act would allow dietary supplement producers to exercise their First Amendment right to notify the public when scientific evidence regarding a supplement's health benefits has been validated. All such claims would be scrutinized by the FDA before being approved and the FDA would retain its authority to attack false or misleading claims. The agency would not, however, be able to continue its present practice of either completely prohibiting or arbitrarily censoring all dietary supplement health claims, which it has done even when overwhelming evidence confirms lifesaving health benefits accompanied by huge health care cost reductions. Federal censorship of the valid claim that adequate consumption of omega-3 fatty acids significantly reduces the risk of sudden death heart attack, for example, absolutely contributes to the fact that America's heart attack death rate remains so appallingly high. During the past 12 years, while heart attacks have taken the lives of an estimated six million Americans, we have known all along that a substantial percentage of these deaths could have been prevented with the omega-3 nutritional intervention. Why, then, does the FDA-approved language for omega-3 fatty acids shortchange the truth that can literally save lives? I must tell you that I am not a paid lobbyist or a dietary supplement industry insider. I'm a cancer survivor who supports clinical and in vitro cancer research. Dietary supplements that happen to be extraordinarily effective as anti-cancer agents would represent an enormous economic threat to the therapeutic sector and to the many people who have collectively invested astronomical amounts of money in the public corporations that profit from the cancer therapy status quo. If such supplements exist, they should be thoroughly studied and the data should be published. In fact, such supplements do exist, and the FDA is doing everything in its unrestrained power to undermine these supplements by sabotaging the science that supports their safety and efficacy. One characteristically vicious campaign began on the morning of February 16, 2005 with an ambush at the home of a board-certified oncologist in Reno, Nevada who is using a remarkably safe palladium lipoic supplement to save the lives of many Stage IV cancer patients - patients who have already tried and failed conventional therapy. This oncologist, Dr. James Forsythe (Retired Colonel, US Army Medical Corps), has been conducting an outcome-based cancer study and periodically reporting the unprecedented data to his colleagues. Federal agents forced Dr. Forsythe to lie down on the floor of his home exercise room, held a gun to his head and raided his entire house while another squad was raiding his medical offices, seizing confidential patient files, computers and many other business and personal items, obviously terrifying his wife, staff and patients in the process. The government's attempt to justify these horrific raids is mind-bogglingly absurd, involving some convoluted story about "the supplier of one of his suppliers." Although the "supplier's supplier" story has absolutely nothing to do with Dr. Forsythe's impeccably administrated cancer study, obstructing the cancer study ultimately became the focus of the raiders' obsession. The FDA's seek-and-destroy tentacles have now stretched from Nevada to New York. Once again finding the science to be unblemished, the FDA has resorted to intimidation tactics to make life miserable for a prominent scientist at Stony Brook University who has identified exactly how palladium lipoic complexes induce apoptosis (cellular suicide) in cancer cells while supporting natural healing processes in normal cells. An enacted Health Freedom Protection Act may clear the way for the free flow of truthful health information, but the FDA's outrageous abuse of power will likely intensify as the agency will surely redouble its efforts to attack scientists who are engaged in research that may give rise to such information. In this great nation, government censorship that contributes to our horrendous morbidity and mortality statistics and police-state raids on the homes and offices of honorable, superbly credentialed health care professionals are atrocities of unspeakable magnitude.
